Terms and Conditions for Real Estate Listing

1. When the buyer requests from the company Premium SM d.o.o. to act as a broker in selling their real estate, the agent will come and inspect the real estate, review the documents proving the title, make the seller familiar with the average real estate market price and then agree with the seller the real estate price as well as other sale-related details. After all the aforementioned, the seller will sign the Real Estate Brokerage Contract.  With seller’s consent, the agent will take photos of the real estate with the aim of presenting the real estate to the possible buyers as good as possible.   The agent will warn the seller (the principal) about evident disadvantages and possible risks with regard to the unsolved land registry status of the real estate, registered property rights and other third party’s rights over the real estate and about restrictions in legal transactions.    

Obligations of the company Premium SM d.o.o. towards the seller are as follows:

  • With the due care and diligence to inform the seller on opportunities to act as a broker with prospective buyers,
  • To advertise the real estate as defined by the broker,  
  • To perform actions necessary for presenting the real estate on the market,
  • To keep principal’s personal data and, on principal’s written order, to keep as a business secret information on the real estate for which he acts as a broker or information related to such a real estate or information related to a legal transaction in which he acts as a broker, 
  • To inform the principal on any and all circumstances important for the intended transaction,  
  • To act as a broker in negotiations required for reaching an agreement to sell the real estate in question,   
  • To draft the preliminary real estate sale and purchase contract / real estate sale and purchase contract,
  • To attend the payment procedure of the purchase and sale price and draw up the record on handover of the real estate.  

For the brokerage service rendered in the course of selling a real estate the company Premium SM will charge a commission from the seller in accordance with the Brokerage Contract entered into between Premium SM d.o.o. and the seller and in which the amount of brokerage fee is agreed.

The brokerage fee (commission) is paid in entirety at latest when the real estate sale and purchase contract is signed on the grounds of an issued invoice whereby the right is reserved to collect the brokerage fee (commission) also from the buyer, in accordance with the brokerage contract   signed with the buyer in the course of buying the real estate, if also the buyer signed the brokerage contract when buying the real estate.   

2. When the buyer requests the brokerage service in the course of buying the real estate, the company Premium SM d.o.o. will sign the brokerage contract with the buyer after which all terms and conditions of real estate sale and purchase will be agreed such as the purchase and sale price, payment methods for the purchase and sale price, entering into the possession and alike.

Obligations of the company Premium SM d.o.o. towards the buyer, after the brokerage contract has been signed, are as follows:

  • To find an appropriate real estate and show it to the buyer,
  • To present to the buyer the title proof for the real estate that is the subject of the purchase,
  • To provide drafting of the preliminary real estate sale and purchase contract/ real estate sale and purchase contract,
  • To arrange at the Notary Public’s the certification of the signature on both the preliminary real estate sale and purchase contract/ real estate sale and purchase contract
  • To attend the payment procedure of the purchase and sale price and handover of the real estate and draw up the record on handover of the real estate and based on a Power-of-Attorney to do the following:
  • To submit the Tax Administration Office and Municipality the registration for property tax on vacation homes
  • If the assessment of the real property by the Tax Administration Office is required, to attend the assessment procedure
  • To transfer utility services, electrical energy, water and other utility providers from the seller’s to the buyer’s name
  • Together with the buyer to submit the proposal for pre-registration, vindication for pre-registering the ownership right or registration of ownership right on the bought real estate to the buyer’s name
